26No person shall institute a prosecution for an offence under this Act unless
(a)
the Labour and Employment Board has found that a person has violated or failed to comply with a provision of the Act or violated or failed to comply with an order made under the Act, and
(b)
the written consent of the Attorney General has been obtained.
